Revised Uniform Fiduciary Access to Digital Assets Act Provides Important Procedures for Dealing with Digital Assets Following a Death

Maryland (SB239/HB507) is one of the 28 states which have either enacted or introduced this legislation.  As the world moves increasingly online, our digital assets are fast becoming some of our most personal assets we own.  These are our email correspondence with loved ones, our digital photo archive, and our social media platforms.  Who has access to these assets upon a loved ones’ passing?  Currently, the answer is not entirely clear.  Many social media providers and other online providers have their own policies regarding who exactly can access your information.  In an effort to promote uniformity and clarity, states are moving towards adopting the Uniform Fiduciary Access to Digital Assets Act.
